It was good to read the note from your employer. Where do things stand as of today?
I heard back from [advisor] today. This is what he told me about switching to a new practicum placement:
Our students have the option to collect their hours at multiple places at all times. The internship is structured so students can start collecting their hours as of the 1st day of the second semester and they have 15 months to collect their hours. They can choose to do the hours in just one place or multiple places or – as in this case – if one place does not work out they can leave and then find an alternate place to complete the hours they are missing.
The one tricky part here is the legality of the situation. Our Program agreements are set up by SAIT to provide protection to the students and employer and the contract states the following:
“Either party may terminate this Agreement upon 30 days' prior written notice to the other parties or, in the event of breach hereof by any other party, upon 10 days written notice to the other parties if the breach is not remedied within the 10 day period. In the event the Company shall file or have filed against it proceedings in bankruptcy or insolvency, SAIT may terminate this Agreement forthwith upon written notice to the other parties.”
If both parties agree on an immediate conclusion of the contract then we are fine. However if the employer insists on a 2-week notice to allow him/her to find another employee then we could have an issue unless this is filed as an official complaint.
I do not foresee an issue but there is always a chance that an employer is evoking this clause.
Bottomline is that as long as a student finds a new placement, does a new program approval for the place and a new contract with the new place, he/she can complete the hours at another place.
It sounds like your employer is not going to invoke the 2 weeks notice clause, but please let me know for my clarification.
Please let me know how you are doing and what support I can offer you when you get a chance.
I spoke with Ombudsperson, this morning. She agreed that an alternate practicum placement would be a good option for you, given how you are being treated at the current placement.
I have sent an email to [the advisor of school]. His message indicated that he is away from the office today, but will be back tomorrow. I think the next step is to talk with him and find out what your options are for completing the program within the expected timeframe.
Once I have talked with him, I will be in touch to talk about a go-forward plan. In the interim, I am happy to be a support for you. Please feel free to make another appointment to talk more about your well-being.
I would suggest waiting until tomorrow before you leave the job, if possible. I would like for us to find out what the proper process to follow is in situations like this. If you are unable to work due to medical issues, that is all you need to say for now. I can write a note on your behalf is one is required.
I want you to know that you are never obligated to work in an environment that is not emotionally and physically safe for you. We will come up with a plan for communicating with your employer where you are not in a vulnerable position. You don’t have to deal with this on your own anymore.
If you get an email from your employer today, you do not have to respond today. If you choose to, the only thing you need to say is that you are unable to work for medical reasons. You don’t have to give a timeline for this until we get a go-forward plan in place over the next day or two. If the employer asks for a medical note, I can write this for you tomorrow.
I hope you are able to get some rest tonight.
I will talk with you tomorrow.
Thank you very much for sending me these notes on your experience. I’m in shock about this and can’t express my apologies enough. This is not the environment that I would every think could happen in one of my venues.
I want you to know I take this very serious and I will be sitting down with Ming personally and having a discussion.
Is there you need from me at this point? I will let Ming know that you have chosen to leave so you don’t need to confront him.
Again, I’m so very sorry and what I could tell you were doing a great job and worked very hard.
梳理一下我可以做的和我为什么回避这么做，写出来看看哪些是I feel like but not real
